Terms and Conditions

1. This Promotional Competition (the “Competition”) is organised by the Mauritius Tourism Promotion Authority and/or their designated agencies (the “Promoter”).

2. The Competition is open to participants who are permanent residents and citizens of South Africa over the age of 18 (eighteen) years, in possession of a valid South African identity document and a valid South African passport (referred to as “Participants/Entrants”).

3. Any employee, director, member, partner, agent or consultant or any person directly or indirectly who controls or is controlled by the Promoter and/or immediate family members of any employee, director, member, partner, agent or consultant of or person indirectly or directly in control or controlled by the Promoter, its advertising agencies, advisers, its affiliates and/or associated companies (“Disqualified Participants”) is ineligible to enter the Competition.

4. By entering the Competition, all Participants and winners agree to be bound by these rules as interpreted by the Promoter, whose decision regarding any dispute will be final and binding. The Promoter reserves the right at any time without notice to amend, modify, or change these rules, and to postpone, suspend or cancel this Competition and any prizes (which have not yet been subject to a draw), or any aspect thereof, without notice at any time, for any reason which the Promoter reasonably deems necessary.

5. The Competition commences on 23 March 2018 and ends on 13 April 2018, both days inclusive (“the Duration”).

6. Participants stand a chance of winning 1 (one) of 2 (two) prizes (“Prizes”).

7. The Prizes are made up as follows:

a. Prize 1:

i. 1 x 5-night all-inclusive stay at the adults-only (16 years and older), 4-star Ambre Resort & Spa, A Sun Resort Mauritius, for 2 (two) people sponsored by World Leisure Holidays.

ii. 2 x return economy class flight tickets, from Johannesburg or Durban or Cape Town, to Mauritius sponsored by Air Mauritius. Flight on Air Mauritius operated flights only.

iii. 2 x return airport taxes sponsored by Mauritius Tourism Promotion Authority.

b. Prize 2:

i. 1 x 5-night half-board (dinner, bed and breakfast) at the 5-star Long Beach, A Sun Resort Mauritius, for 2 (two) people sponsored by World Leisure Holidays.

ii. 2 x return economy class flight tickets, from Johannesburg or Durban or Cape Town, to Mauritius sponsored by Air Mauritius. Flight on Air Mauritius operated flights only.

iii. 2 x return airport taxes sponsored by Mauritius Tourism Promotion Authority.

8. To stand a chance of winning 1 (one) Prize, Participants must like the Mauritius Tourism South Africa Facebook page and enter their contact details on the Mauritius Tourism South Africa competition entry web page found at www.ratherbeinmauritius.co.za/win.

9. The Promoter will conduct a random draw from all the Entries received to determine the winners in the following manner:

a. A draw (“the Draw”) within a week of the Competition end date in order to determine the “Prize Winners” ;

b. In order for a particular Entry to be confirmed as valid, the Promoter will contact the potential winner via Facebook Direct Message to ensure that the qualifying criteria set out in paragraphs 2, 3, and 7 above are met (“the verification process”).

10. The Promoter’s decision is final and no correspondence will be entered into.

11. Participants may not enter this Competition or qualify to be a winner if they have won a competition promoted by the Promoter within the past 12 (twelve) months.

12. Entries that are submitted via an incorrect entry mechanism, or contain errors, or are unclear or illegible, or are received from Disqualified Participants, will be declared invalid.

13. Participants whose Entries have been drawn and have been confirmed by the Promoter as valid after the verification process, will be notified via Facebook Direct Message.

14. If the Promoter is unable to reach a Prize Winner after 24 (twenty four) hours from the date of being selected as a potential winner, or if a Prize Winner fails the verification process after drawing his/her Entry for whatsoever reason, such person will be disqualified and a draw for a replacement Entry and winner will take place.

15. The Promoter will arrange Prize delivery with the Prize Winners via email.

16. The Prizes are neither transferable nor redeemable for cash and may not be sold to a 3rd (third) party. The Promoter reserves the right to substitute the Prizes with any other prize of comparable commercial value.

17. The Prizes exclude domestic flights within South Africa or Mauritius, transfers, travel insurance, food and beverages not included in the meal plans specified, and items of a personal nature i.e. laundry, spa treatments, etc.

18. The Prizes are subject to availability of flights and accommodation at the hotels concerned. Flights are subject to confirmation 15 days prior to departure in economy class.

19. World Leisure Holidays reserves the right to move the reservation to another hotel if necessary.

20. The Prizes are valid for travel within 12 months of the Prize Winners being notified of winning and may not be extended.

21. The Prizes cannot be redeemed during school holidays and peak seasons. Flights may not be booked in the following peak periods:

a. 28 Mar 18 – 09 Apr 18
b. 22 Jun 18 – 16 Jul 18
c. 28 Sep 18 – 08 Oct 18
d. 12 Dec 18 – 08 Jan 19

22. Names given for travel must be as per passport.

23. South African passports must be valid for a minimum of six months from the date of your return.

24. No liability shall attach to the Promoter in relation to any claims, losses or liabilities for any loss of profit or any other direct and/or indirect, special or consequential loss arising out of any of the prizes. The Promoter is not liable for any defects in the Prizes. Ownership of and risk in, and benefit attaching to, the prizes will pass to you immediately.

25. Should any dispute arise in relation to the interpretation of the Competition rules, the Promoter’s decision shall be final and no correspondence shall be entered into.

26. All Participants and winners, as the case may be, indemnify the Promoter, its advertising and promotional agencies, advisers, nominated agents, partners, suppliers, its affiliates and/or associated companies against any and all claims of any nature whatsoever arising out of and/or from their participation in any way howsoever in this Competition (including, as a result of any act or omission, whether as a result of negligence, misrepresentation, misconduct or otherwise on the part of the Promoter and/or use of the Prizes).

27. The Promoter may require the winners to complete and submit an information disclosure agreement and indemnification to enable the Promoter to ensure compliance with these Rules and the Consumer Protection Act 68 of 2008. Should any winner refuse or be unable to comply with this rule for any reason, such a winner will be deemed to have rejected the Prize and it shall revert back to the Promoter.

28. The Promoter may require the winners to be identified, photographed and published in printed, digital and social media, or to appear on radio and television, when accepting their prizes or after having received their prizes. The Promoter may also use the uploaded images in whole or in part, and any reproductions thereof, worldwide for advertising, promotion, publicity or otherwise on any website for any media purpose and for any other lawful purpose whatsoever. The winners will be given the opportunity to decline to the publication of their images and to participate in the Promoter’s marketing material in so far as it relates to the Competition.

29. You will be required to provide your full name, email address and other related information when entering this Competition. By entering the Competition, the Participants agree that the Mauritius Tourism Promotion Authority and its affiliates (including the Promoter, agencies, subsidiaries, and sponsors) may contact the participants via email and through social media platforms to deliver marketing communications regarding their products and promotional activities, provided that the Participants are given the opportunity to opt-out of receiving marketing communication at any time via the appropriate opt-out mechanisms provided by the Promoter for such purpose. We will not use your personal data for a different purpose without first obtaining your permission. We do not allow third parties to use your personal information.

30. Participants may not misuse the site, the Mauritius Tourism South Africa page or Competition in any way. This includes posting content for commercial purposes or distributing spam or malicious code or using the site to collect the personal data or content of other users or direct visitors to other sites or pages.

31. Participants must comply with the terms & conditions and privacy policies of the site.

32. The Promoter is not responsible for the site. The Promoter cannot control how it operates, when or if it is available, or what content it carries. Even though the Promoter runs the Competition on the site, the Promoter does not endorse the third party, its site, its products, or services or any content on the site. Participants use the site at their own risk. Participants must take all necessary measures to protect themselves and any minors, from risks, such as viruses and other destructive code.

33. Participants must obtain at their own expense all equipment and services that are necessary to gain access to the site to take part in this Competition.

34. The Promoter can put in place such technical or other remedies it considers appropriate to prevent abuse, or to protect any sites or our systems or other users.

35. By posting any content, experiences, images on any social media platform, in relation to this Competition and its associated promotional activities, Participants consent and give the Promotor a world-wide, royalty free and non-exclusive license, to reproduce, modify, adapt and publish any content posted and/or submitted by a Participant on a social media site, for the purposes of promoting the products and services of the Promoter.

36. The Competition is in no way sponsored, endorsed or administrated by, or associated with Facebook, Twitter, or Instagram, or any other social media platform. Participants provide their information to the Promoters and not to Facebook, Instagram or Twitter, or any other social media platform.

37. All queries relating to the Competition can be directed to the Mauritius Tourism South Africa Facebook Messenger (Monday – Fridays from 08:00 to 17:00). A copy of the Competition rules is available at no cost to the participants and can be downloaded in printable form at www.ratherbeinmauritius.co.za/terms.
